By accessing or using Fusion Hub ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not use the Service.

1.1 Modifications

We reserve the right to modify these Terms at any time. We will provide notice of significant changes through our website or via email. Your continued use after changes constitutes acceptance.

2.1 Eligibility

To use certain features, you must register for an account. You represent that:

• You are at least 16 years old (or the legal age in your jurisdiction)
• All registration information you provide is accurate and truthful
• You will maintain the security of your credentials

2.2 Account Responsibilities

You are responsible for all activities under your account. Notify us immediately of any unauthorized use.

3.1 Grant of License

Subject to these Terms, Fusion Hub grants you a limited, non-exclusive, non-transferable, non-sublicensable license to use our products under these conditions:

• For personal or commercial projects
• On up to 2 devices per license purchased
• Not for redistribution, resale, or sublicensing
• In compliance with all applicable laws

3.2 Restrictions

You may not:

• Reverse engineer, decompile, or disassemble our products
• Remove or alter any proprietary notices
• Use our products to create competing services
• Bypass any security or access controls

4.1 Pricing

All prices are listed in USD unless otherwise specified. We reserve the right to change prices at any time, but changes will not affect active subscriptions.

4.2 Refund Policy

Due to the digital nature of our products:

• We offer refunds within 14 days of purchase for defective products
• Refund requests must include proof of defect
• No refunds for change of mind or failure to meet system requirements

4.3 Subscription Terms

For subscription products:

• Billing occurs at the beginning of each cycle
• Auto-renewal can be disabled anytime before renewal
• Cancellation stops future billing but doesn't refund current period

You retain ownership of content you create using our products ("User Content"), but grant us a worldwide license to use, display, and distribute User Content for service operation and improvement.

5.1 Prohibited Content

You may not create or share content that:

• Violates any laws or third-party rights
• Contains viruses or malicious code
• Is defamatory, obscene, or harassing
• Promotes illegal activities

All rights, title, and interest in our products (including software, designs, and documentation) remain our exclusive property. These Terms grant only a license as specified, not a transfer of ownership.

We may suspend or terminate your access immediately if you breach these Terms. Upon termination:

• Your license rights terminate immediately
• You must cease all use of our products
• No refunds will be provided (except as required by law)

You may terminate your account at any time through your account settings.

8.1 Service "As Is"

Our services are provided "as is" without warranties of any kind. We do not guarantee that:

• The service will be uninterrupted or error-free
• Results from using the service will meet your requirements
• Defects will be corrected

8.2 Limitation of Liability

To the maximum extent permitted by law, Fusion Hub shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Damages exceeding the amount you paid in the last 12 months

These Terms shall be governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of San Francisco County.

By participating in the Fusion Hub Affiliate Program ("Affiliate Program"), you agree to comply with the following additional terms and conditions, which are incorporated into and form part of these Terms of Service.

10.1 Eligibility

• You must be at least 18 years old to join the Affiliate Program.
• Only one affiliate account is permitted per individual or business.
• Your application must provide accurate and complete information.

10.2 Affiliate Responsibilities

• You are solely responsible for the accuracy of promotional content you create.
• You must not make false, misleading, or unapproved claims about Fusion Hub products or services.
• You agree to comply with all applicable advertising and marketing laws, including disclosure requirements for affiliate links.

10.3 Commission & Payments

• The standard commission rate is 20% of the net sale value (excluding taxes, refunds, and chargebacks).
• Commissions are calculated monthly and paid once your earnings meet the minimum payout threshold of $50 USD.
• Payments are made via the method selected in your affiliate dashboard; you are responsible for ensuring your payment details are accurate.
• Fusion Hub reserves the right to withhold or adjust commissions for fraudulent, canceled, or refunded orders.

10.4 Prohibited Activities

• Engaging in spam, unsolicited commercial emails, or deceptive marketing practices.
• Bidding on Fusion Hub brand keywords in search engine ads without prior written approval.
• Using affiliate links on websites containing adult content, hate speech, or illegal materials.

10.5 Termination

We may suspend or terminate your affiliate account immediately if you breach these terms, engage in fraudulent activity, or harm our brand reputation. Upon termination, unpaid commissions below the payout threshold will be forfeited.

10.6 Modification

Fusion Hub reserves the right to modify the Affiliate Program, commission rates, or these terms at any time. Continued participation after changes constitutes acceptance.

Fusion Art Studios provides a marketplace where freelancers may create professional profiles, publish portfolios, list services or gigs, communicate with clients, receive project opportunities, and complete freelance work.

Clients may use the marketplace to discover freelancers, review professional profiles and portfolios, purchase services, communicate regarding projects, and manage orders through available platform features.

Freelancers are responsible for maintaining accurate professional information and delivering services in a professional manner.

• Provide accurate information regarding skills, experience, services, pricing, and portfolio work.
• Only publish work that you have the right to display or use.
• Deliver work according to the agreed project requirements and applicable order details.
• Communicate professionally and respectfully with clients.
• Do not misrepresent experience, qualifications, identity, previous work, or professional capabilities.
• Maintain reasonable communication regarding project progress and delivery.
• Comply with applicable laws and platform rules.

Repeated failure to meet professional marketplace standards may result in warnings, reduced visibility, account restrictions, suspension, or termination.

Clients using Fusion Art Studios are responsible for providing clear and lawful project requirements and interacting with freelancers professionally.

• Provide accurate project requirements and relevant instructions.
• Provide required materials or information necessary for project completion.
• Review delivered work reasonably and according to agreed project requirements.
• Do not request illegal, infringing, abusive, or prohibited services.
• Do not misuse platform communication or payment systems.
• Do not intentionally attempt to avoid applicable marketplace obligations after placing an order.

Fusion Art Studios may use an order-based payment workflow designed to support clients and freelancers during project transactions.

Fusion Art Studios may maintain order records, transaction information, delivery information, and communication records where necessary for platform operation, support, security, disputes, and financial administration.

Fusion Art Studios may offer Free, Pro, and Ultimate subscription plans. Features and benefits may differ depending on the selected plan.

Subscription features may be modified, expanded, discontinued, or updated according to platform development. Active users may be notified where a significant change materially affects an existing plan.

Based on the marketplace subscription structure, commission and payment clearance conditions may apply as follows:

• Free Plan: 5% commission on applicable orders with a 10-day payment clearance period.
• Pro Plan: 0% commission on applicable orders with a 5-day payment clearance period.
• Ultimate Plan: 0% commission on applicable orders with a 24-hour payment clearance period.

Fusion Art Studios may delay, review, hold, adjust, or investigate payments where reasonably necessary to address fraud, disputes, refunds, chargebacks, technical issues, security concerns, or violations of these Terms.

17.1 Revisions

Where revisions are included in a service offering or agreed between the parties, revision requests should remain reasonably related to the original project scope.

17.2 Cancellations

Cancellation requests may be reviewed according to the status of the project, work completed, order history, evidence provided, and applicable marketplace processes.

17.3 Disputes

Users should first attempt to resolve disagreements professionally through communication. Fusion Art Studios may review relevant information where platform support or dispute assistance is available.

• Relevant messages and order records may be considered.
• Project requirements and delivery information may be reviewed.
• Evidence provided by either party may be considered where applicable.
• Platform decisions may be made based on available information and operational policies.

Clients and freelancers may have access to ratings, reviews, badges, reputation indicators, or marketplace recognition features where available.

• Reviews should reflect genuine experiences.
• Users must not manipulate ratings or feedback systems.
• Fake, misleading, retaliatory, abusive, or fraudulent reviews may be removed.
• Users must not offer compensation in exchange for false ratings or reviews.
• Marketplace badges and recognition may depend on eligibility criteria and platform evaluation.

Fusion Art Studios reserves the right to investigate suspicious review activity and take action to protect the integrity of marketplace reputation systems.

Freelancers may publish portfolios, services, gigs, images, videos, descriptions, pricing, and related professional content through available marketplace tools.

• You must have the right to publish the content you upload.
• You must not publish confidential client work without permission.
• You must not use stolen, copied, or infringing portfolio materials.
• Service descriptions must reasonably represent the service being offered.
• Pricing and delivery information should be accurate and not intentionally misleading.
• Fusion Art Studios may remove content that violates platform rules or applicable law.

Users may not use Fusion Art Studios to engage in fraudulent, abusive, unlawful, deceptive, or harmful activity.

• Creating fake or deceptive accounts.
• Impersonating another individual or business.
• Providing fraudulent portfolio or professional information.
• Manipulating orders, ratings, reviews, rankings, or marketplace visibility.
• Using stolen payment methods or engaging in payment fraud.
• Uploading malware, malicious files, or harmful code.
• Harassing, threatening, abusing, or discriminating against other users.
• Using the marketplace for illegal activities.
• Attempting to bypass platform security or access controls.

Fusion Art Studios may conduct Business Development activities to acquire clients and create professional opportunities for freelancers using the platform.

Relevant freelancer profiles, portfolios, skills, and service information may be considered when identifying suitable professionals for client opportunities.

• Client opportunities are not guaranteed to any freelancer.
• Profile selection may depend on skills, project requirements, availability, quality, and marketplace eligibility.
• Pro and Ultimate users may receive additional visibility according to available plan benefits.
• Business Development activity does not guarantee a specific number of projects, clients, or earnings.

Fusion Art Studios may investigate suspected violations of these Terms or other applicable platform rules.

Depending on the nature and seriousness of an issue, platform action may include:

• Content removal or editing requests.
• Warnings or restrictions on specific features.
• Temporary account limitations.
• Order or payment review where applicable.
• Suspension of marketplace access.
• Permanent account termination for serious or repeated violations.

We may take immediate action without prior notice where reasonably necessary to address security threats, fraud, illegal activity, serious abuse, or risks to users or the platform.

Freelancers using Fusion Art Studios generally operate as independent service providers and are not employees, agents, partners, or representatives of Fusion Art Studios solely because they use the marketplace.

• Freelancers remain responsible for their own professional and business obligations.
• Freelancers are responsible for applicable taxes and legal obligations relating to their earnings.
• Clients and freelancers remain responsible for agreements relating to the specific services they exchange.
• Fusion Art Studios does not automatically create an employment relationship between clients and freelancers.

Unless otherwise agreed between the client and freelancer, ownership and usage rights relating to delivered project work may depend on the applicable service description, project agreement, order terms, or written arrangement between the parties.

Freelancers should not transfer rights they do not own, and clients should not assume rights beyond those agreed for the purchased project.

• Third-party assets, fonts, stock materials, plugins, or licensed content may have separate license restrictions.
• Users are responsible for obtaining required permissions for materials supplied to a project.
• Confidential project information should not be publicly disclosed without authorization.
• Portfolio display rights should be agreed where client confidentiality applies.

These Terms of Service apply together with applicable Privacy Policies, Refund Policies, subscription terms, platform rules, product licenses, and other policies published by Fusion Art Studios or Fusion Hub.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue to apply to the extent permitted by law.

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other right.
